Continental PSI Privacy Policy

This Privacy Policy (“Policy”) describes how Continental Tire Canada, Inc. (“CTCI”, “Our”, “Us” or “We”) collects, uses, discloses and protects Your Personal Information (i.e., information about You) that CTCI collects, processes, or otherwise has access to when You register for an account on or visit www.contipsi.com (“Website” or “Service”) or otherwise participate in (or register to participate in) the PSI Program (“Program”).

Acceptance of Policy

By downloading, accessing, and/or using the Website, registering for an account or to participate in the Program, or otherwise providing Your Personal Information to CTCI in connection with the Service or Program, You signify Your acceptance of this Policy and agree that We may collect, use, disclose and otherwise process Your Personal Information as described herein. If You do not agree to this Policy, do not provide Your Personal Information to Us or register for an account and immediately discontinue Your use of the Website.

Personal Information We Collect, Use and Share

In providing the Service and administering the Program, CTCI may collect, use, process, transfer, or otherwise have access to various information and data, including Your Personal Information. “Personal Information” refers to any information about an individual, meaning there is a serious possibility that an individual could be identified through the use of that information, alone or in combination with other information, subject to any exclusions under applicable laws, and includes the terms “personal data”, “personal information”, and such other substantially equivalent terms defined in applicable laws.

 

The types of Personal Information from or about You that CTCI may collect, use, share or otherwise process during Your registration for and use of the Service or participation in the Program include:  

 

  • Identifiers and contact information, such as Your full name, alias, postal/home address, country of residence, unique personal identifier, online identifier, internet protocol address, email address, phone number (personal and cell), fax number, , and other similar identifiers.
  • Account information, such as Your username, account number, account password, and answers to account security questions.
  • Financial information, such as Your bank account number, credit card number, debit card number, government issued Tax ID, any Personal Information included in the tax forms that You submit to Us (e.g., information about Your income and Your eligibility for certain tax credits), any Personal Information included in the invoices that You submit to Us, and other financial information.
  • Commercial information and preferences, including records of Your personal property, creditworthiness, products or services purchased, obtained, or considered, or other purchasing and consuming histories or tendencies.
  • Internet or other electronic network activity information, such as information regarding Your interactions with Us (including when You interact with the Website or through Our advertisements).   • Geolocation information, such as Your longitude and latitude when You access the Website or use the Service, which we ascertain from your IP address.
  • Professional or employment information, such as business address, , information about the dealership for which You work (e.g., dealer name, address, manager’s name, business owner name, business owner email, manager’s email address, phone number and email address), (e.g., whether You are still employed by the dealer), and Your sales information (e.g., dates of transactions and units You sell).
  • Customer support data, including information collected when You contact us for help with Your account or otherwise in connection with Your registration for or participation in the Program (including, but not limited to, Your full name, telephone number and contact information and a summary of issue(s) discussed).

 

Privacy expectations and regulations are continually changing, and Our use and handling of Your Personal Information may change over time to meet those changes and expectations.  If Our use or handling of Your Personal Information changes in a material way, We will generally notify You and, if required by applicable law, obtain Your consent (see Modifications section below).

 

Sources of Personal Information

 

We collect information, including Personal Information, about You and how You interact with Us in several ways, including:

 

  • Information You Provide to Us Directly. We collect the information You provide to Us directly, such as when You register for an account on the Website or submit Your tax forms or invoices to Us.
  • Information Collected from Your Employer. We may collect information about You from Your employer, including if We conduct an audit of Your employer’s Program records.
  • Information from Your Mobile Device. You may upload invoices to the Website using Your mobile device, which requires access or permission to Your mobile device’s camera. If You wish to restrict Our access or permissions, You may do so in Your device’s settings. Restricting Our access may negatively impact Your ability to upload invoices to the Website from Your mobile device.
  • Information Automatically Collected or Inferred from Your Interaction with Us. We automatically collect technical information about Your interactions with Us, such as the time You use the Website. Before providing Us with Personal Information about another person, You are responsible for providing such notices to and obtaining such consents from that person as are required by applicable law.

How We Use Your Personal Information

 

We may collect, use, disclose and otherwise process Your Personal Information for the following purposes:

 

  • To Provide and Maintain the Website and Enable Interactions Between You and CTCI. We will process Your Personal Information to deliver, develop and maintain the Website. This includes, but is not limited to, facilitating registration and administration of Your account; supporting and facilitating Your interactions with Us; diagnosing, repairing and tracking service and quality issues; facilitating an order, download, return, or exchange; providing requested information; communicating with You about Your account or Our data practices; installing and configuring changes and updates to the Website, programs and technologies related to interactions with Us; authenticating the identity of those who interact with Us; or investigating and responding to Your requests, complaints, and inquiries.
  • To Administer the Program. If You register to participate in the Program, We may process Your Personal

    Information to consider and process Your enrollment in the Program; assess Your eligibility to participate in the Program; monitor and enforce compliance with the Program Rules and Terms of Use; send You notices with respect to the Program; process any invoices, claims, sales reports or other documentation that You submit to Us in connection with the Program, including assessing Your eligibility for and awarding points or other awards; fulfil rewards orders, including mailing You rewards; process Your exception requests; conduct audits of Your or Your employer’s records related to the Program; and prepare, issue and file tax forms (such as a T4A form), where applicable.  

  • To Provide Customer Support. CTCI has a relatively large customer support staff relative to Our customer base. We strive to provide quality products and services including supporting You when You need it. To do this, We may process Your Personal Information to investigate and assist You in resolving questions or issues You have regarding CTCI products and services, the Program, the Website or the Service, provide You support or respond to You.
  • For Our Internal Business Purposes. We may process Your Personal Information for Our internal business purposes related to providing the Website or Service or administering the Program, as well as other products and technologies. This includes, but is not limited to, evaluating or auditing the usage and performance of the Website, or other programs and technologies related to interactions with Us; evaluating and improving the quality of Your interactions with Us and the Website, or other programs and technologies related to interactions with Us; designing new services; performing internal research for technological development and demonstration; conducting data analysis and testing; and maintaining proper business records and other relevant records.
  • For Legal, Safety or Security Reasons. We may process Your Personal Information for the purposes of complying with legal requirements and Our contractual obligations; protecting the safety, property or rights of CTCI, You, and those who interact with Us, or others; and detecting, preventing, investigating and responding to security incidents or other malicious, deceptive, fraudulent, or illegal activity, including (without limitation) violations of the Program Rules or Terms of Use.
  • In a De-identified, Anonymized or Aggregated Format. When converted to a de-identified, anonymized, or aggregated format, this data no longer constitutes Personal Information and We may use this information for any purpose, to the extent permitted by applicable law.

 

With Whom We Share Your Personal Information 

We do not currently sell Your Personal Information, nor do We have any plan to do so.  However, We may share Your Personal Information with these recipients:

 

  1. CTCI Personnel. Your Personal Information may be accessed by or shared with personnel of CTCI who have a need to know such information, including members of Our PSI Award Headquarters Customer Service, Program Management and Marketing teams, depending on the Personal Information they each require in order to perform their job duties and responsibilities.
  2. Affiliates and Subsidiaries. We may share Your Personal Information within the CTCI group of companies, which includes parents, corporate affiliates, subsidiaries, business units and other companies that share common ownership with CTCI, who may use Your Personal Information for the same purposes described above. Such transfers to affiliates will be in accordance with CTCI’s Binding Corporate Rules (“BCRs”), a copy of which is available here: CTCI’s Binding Corporate Rules.
  3. Service Providers. We may share Your Personal Information with third party service providers working on behalf of Us in order to provide the Website, administer the Program or otherwise facilitate an interaction with CTCI that You request or support Our relationship with You, such as Our licensors, platform and hosting service providers, IT providers, operating systems and platforms, internet service providers, analytics companies, and marketing providers (e.g., We may share Your email address with Our outbound email marketing provider).We may contract with other companies to provide certain services, including shipping, identity verification, email distribution, market research, promotions management and payment processing, who may also have access to and process Your Personal Information for the purposes set out above. We provide these companies with only the Personal Information they need to perform their services and work with them to ensure that Your privacy is respected and protected. These companies are prohibited by contract from using this Personal Information for their own marketing purposes or from sharing this Personal Information with anyone other than CTCI. Without limiting the foregoing, as of the Effective Date of this Policy We may share Your Personal Information with the following service providers:

    a. The Advertising Checking Bureau, Inc., (“ACB”)

We have engaged ACB to host and manage the Website and assist Us in the administration of the Program.  In order to maintain the Website and administer the Program, ACB may process or otherwise have access to all of the Personal Information otherwise described in this Policy. b.     We reserve the right to change service providers or introduce new service providers as We, in our sole discretion, deem appropriate.  When we update or change service providers, we will modify this list and, where required by law, seek your 

  4. For Legal, Security and Safety Purposes. We may share Your Personal Information with third parties such as law enforcement or other government agencies or regulators to comply with law or legal requirements; to enforce or apply Our Terms of Use, Program Rules and other agreements; and to protect Our rights and the property or safety of CTCI, Our users, You or third parties.
  5. In Connection with a Transaction. If We sell some or all of Our assets, or merge with or are acquired by another entity, including through a sale or in connection with a bankruptcy, We may share Your Personal Information with that entity.

Cookies and Analytics Tools

When you visit the Website, information can be stored on your computer in the form of cookies. Such cookies are used solely for the purpose of optimum Website design. Technically necessary cookies are only used to ensure the operation of the website. Your Rights

Please note that under applicable data protection laws and regulations You may have the following rights in connection with CTCI’s processing, collection, use and sharing of Your Personal Information, subject to certain permitted or required exceptions under applicable law:

  • Right of Information. You may receive information about your ability to refuse consent and the consequences associated with such refusal.
  • Right to Notice. CTCI provides this Notice, detailing how Personal Information is processed, including the third parties with which CTCI has shared your Personal Information. CTCI will provide updated notice and information any time the types of Personal Information processed and/or CTCI’s use and sharing of your Personal Information materially change.
  • Right to Revoke Consent. You may generally withdraw Your consent to Our continued use of Your Personal Information, subject to reasonable notice and contractual and other legal limitations. Notwithstanding Our receipt of such a request, We may need to retain Your Personal Information for certain permitted purposes or as required by applicable law.
  • Right of Access. You may request confirmation regarding whether CFCI processes Your Personal Information and, if so, request access to such Personal Information.
  • Right to Correction/Rectification. You may request that inaccurate Personal Information about You be updated or corrected.
  • Right to Deletion. You may have Personal Information deleted in certain circumstances.
  • Right to Restrict Processing. You may have additional processing of Personal Information restricted and/or temporarily blocked while the sufficiency, necessity, accuracy, or legality of processing of the Personal Information is contested.
  • Right to Data Portability. You may be able to receive Personal Information for the purpose of providing that Personal Information to another controller, either through you as our business customer or directly by CTCI.
  • Right to Object. You may object, at any time and on grounds relating to their particular situation, that processing of Personal Information is unnecessary or excessive.
  • Right to Complain to the Relevant Supervisory Authority. If you have a complaint about our privacy practices, you have the right to submit a complaint to a relevant supervisory authority.

CTCI may request additional information from You as necessary to allow You to exercise Your rights, and We may deny Your request where we have a legitimate basis or are required to do so pursuant to applicable law.

Retention

We may store Your Personal Information in physical or digital format in Mississauga, Ontario, Canada; Arlington Heights, Illinois, United States of America.

We will retain Your Personal Information for as long as is necessary to satisfy the purposes for which it was collected or for such longer period as it may be required to protect Our interests, comply with applicable law or defend against claims.  Generally, this would mean that Your Personal Information will be retained for the duration of Our relationship with You, and up to three (3) years following the end of such relationship, though this may vary depending upon applicable legal requirements. In some circumstances We will anonymize Your Personal Information (so that it can no longer be associated with or used to identify You) and use the anonymized data for research or statistical purposes, in which case We may use this information indefinitely without further notice to or consent from You, except as required by applicable law.

International Transfers of Personal Information

We may transfer or store Your Personal Information outside of Canada, including to or in the United States. Personal Information transferred or stored outside of Canada will be subject to the laws of the jurisdiction(s) where it is transferred or stored, and may be accessible to foreign courts, law enforcement and national security authorities in the jurisdiction(s) where it is transferred or stored.   

You may contact dataprotection@conti-na.com to obtain written information about Our policies and practices with respect to service providers (including affiliates) outside of Canada, or to ask questions about the collection, use, disclosure or storage of Your Personal Information by such service providers and affiliates outside of Canada.

Security

We take Your privacy seriously and use reasonable precautions to protect Your Personal Information. For example, We encrypt certain communications using industry standards for encrypting such communications. However, We do not guarantee the security of Your Personal Information.  There is always a risk that information We collect or that You provide to Us may be compromised, including due to unauthorized interception or access by third parties.  To mitigate this risk, You should (a) use unique and secure usernames and passwords for Your account and carefully protect them from disclosure and (b) implement up-to-date security and virus protection on Your device.  If You suspect that Your device’s security or Your Personal Information has been compromised, or Your password accessed or used by an unauthorized third party, please immediately change Your password and/or contact Us at continentalPSI@acbcoop.com to request that Your password be changed.  

Third Party Websites

When You click on a link to any other website or location, You will leave Our Website and go to another site, where another entity may collect or process Personal Information from or about You. We have no control over, do not review or own, and cannot be responsible for, these outside websites, their content, their owners’ actions or their handling of Your Personal Information. Please be aware that the terms of this Policy do not apply to these outside websites or content, or to any collection of data after You click on links to such outside websites.  If You decide to access any third party links appearing on the Website, You do so at Your own risk. We recommend that You carefully read each third party’s privacy policies and terms and conditions before accessing their website or providing them with Your Personal Information.

Policy for Children

The Website is intended for and marketed to adults only.  We do not knowingly solicit information from or market to children under the age of 16. If You become aware of any Personal Information that We have collected from or about children under age 16, please contact Us using the contact information provided above. 

Modifications

We may modify this Policy from time to time as the Website, Program and applicable laws change.  If We change our Policy, We will post a new statement on this Website and update the effective date stated at the end of the Policy.  You are encouraged to review this Policy from time-to-time for any updates or changes. If We make any material changes to this Policy or to our Personal Information handling practices, We will generally inform You through the Website, by sending a message to the e-mail address associated with Your account, or by some other method of communication, subject to the requirements of applicable law.
